Mitigation Hearings

If you request a Mitigation Hearing, you are agreeing that you committed the infraction but want the Court to consider imposing a lower fine.  The single largest factor Judges use is your driving record.  Have you done this before?  Have you committed other infractions?

If you have a clean record, most Judges will reduce the fine.  They will not reduce it to zero but it should come down a little.  There are exceptions to this since some infractions cannot be mitigated - such as speeding in a school zone.  The affect of trying to mitigate a traffic ticket like this is the same as Paying the Fine.

You may have realized already that if you mitigate your traffic ticket, then you will no longer have a clean driving record.  This is not a problem if you wait another ten years before getting a new ticket but what happens if you are cited again?  Generally speaking, it pays to keep your record clean - so fight each and every traffic ticket because it's worth it.
